is not as complicated as it sounds. Agency is a legal term which
quite simply means:
"Who is representing you with your best
interests in mind."
In
a real estate transaction, there are three main types of agency
representation which can occur:
(1)
SELLER'S AGENCY
When
you list with Michell, she undertakes a contractual obligation by
which she and her company are representing you in your best interests.
"Seller's Agency" is established in writing through the
Listing Contract.
(2)
BUYER'S AGENCY
This
means that the other real estate agent who brings forward an offer
on your home is representing the purchaser in their best interests.
Although the other realtor's goal is to sell your property, they
are representing their purchaser. Buyer's Agency may be established
in writing through a Buyer's Agency Agreement.
If
you are using the services of Michell Gunn to purchase another home,
she will represent you as a purchaser under "Buyer's Agency".
(3)
DISCLOSED DUAL AGENCY
This
occurs when another agent from the same company brings forward an
offer on your home. "Dual Agency" also occurs if one of
Michell Gunn's clients wishes to make an offer on your property,
which is listed through her.
